These Terms and Conditions ("Terms") govern the services provided by Cunicaero LLC, a veteran-owned drone services company based in Grand County, Colorado (“we,” “our,” “us”), to any individual or entity ("Client") who engages with our services. By using our services, you agree to these Terms.
1. Services
We provide aerial drone services including, but not limited to: construction monitoring, mapping, progress documentation, inspections, and environmental surveys. Specific services and deliverables will be detailed in a formal quote or service agreement.
2. Scheduling & Availability
All services are subject to weather conditions, airspace restrictions, and equipment readiness. We reserve the right to reschedule services due to safety concerns, FAA regulations, or force majeure events.
3. Payment Terms
Payment is due upon completion of services and issuance of invoice, unless otherwise agreed in writing. Quotes are valid for 30 days. Late payments may be subject to a fee of 2% per month or the maximum allowed by Colorado law.
4. Cancellations & Rescheduling
Clients must notify us at least 24 hours in advance to reschedule or cancel a service. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee.
5. Intellectual Property
Unless otherwise stated in writing, Cunicaero retains full ownership of all raw and edited media. Clients are granted a license to use the deliverables for the agreed purpose. Unauthorized distribution, resale, or modification of the content is prohibited.
6. Client Responsibilities
Clients must obtain all necessary permissions for drone flights on private property and ensure that the site is safe and legal to operate in. We are not responsible for delays or inability to complete a job due to access restrictions or legal barriers not disclosed in advance.
7. Insurance & Liability
Cunicaero is fully insured for commercial drone operations. However, we are not liable for damages resulting from inaccurate client instructions, restricted access, or environmental factors beyond our control.
8. FAA Compliance
All flights are conducted in compliance with FAA Part 107 regulations. Clients may not request services that would require us to violate any federal, state, or local laws.
9. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes arising from these Terms or our services shall be resolved in the courts located within Colorado.
10. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services after changes are made constitutes acceptance of the revised Terms.
